These Terms and Conditions ("Terms") govern your access to and use of the websites, platforms, and services provided by KTH Projects (Pty) Ltd t/a KTH-Tech (registration number 2025/627290/07) ("KTH Tech", "we", "us"). By accessing our services or completing a purchase, you agree to these Terms.
1. Services
KTH Tech provides enterprise technology platforms and products across four hubs — THINKR, BUILDR, DELIVR, and INNOVATR — including software subscriptions, digital products, and professional services. The specific features, scope, and pricing of each product are described on the relevant product page or in your order confirmation.
2. Orders & Payment
- All prices are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable.
- Payment is required in full at the point of order unless a written agreement states otherwise.
- Online payments are processed securely through Paystack, a PCI-DSS compliant gateway.
- Your order constitutes an offer to purchase; a binding contract is formed once we confirm your order and payment is received.
3. Customer Obligations
- You must provide accurate, current, and complete information when placing an order or registering an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You may not use our services for any unlawful purpose or in any way that could damage or impair the services.
4. Subscriptions & Renewals
Subscription products renew automatically at the end of each billing cycle unless cancelled before the renewal date. You may cancel at any time; cancellation takes effect at the end of the current paid period. See our Refund Policy for details.
5. Intellectual Property
All intellectual property in our platforms, software, and content remains the property of KTH Tech or its licensors. Where a product is described as "client-owned", ownership of the delivered deliverable transfers to you on full payment, as set out in your order.
6. Liability
To the maximum extent permitted by law, KTH Tech's total liability arising from or connected to the services shall not exceed the amount paid by you for the relevant product in the three months preceding the claim. Nothing in these Terms limits liability that cannot lawfully be limited under South African law, including the Consumer Protection Act 68 of 2008.
7. Cancellations
Cancellation and refund rights are governed by our Refund Policy, which aligns with the Consumer Protection Act and the Electronic Communications and Transactions Act 25 of 2002.
8. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any dispute shall be subject to the exclusive jurisdiction of the South African courts.
